These Terms of Service (“Terms”) govern your access to and use of the Website, as well as any financial contributions, payments, or product purchases made through it. By accessing the Website or submitting a payment, you agree to be bound by these Terms.
1. Website Ownership and Operation
This Website is owned and operated by Delta Psi Delta Fraternity Corporation. The Website serves as a central digital portal providing information and facilitating voluntary financial support for the multiple distinct legal and tax entities associated with the fraternity.
2. Entity Structure and Tax Deductibility
The Website allows users to direct their financial support to specific, separate legal entities. The tax deductibility of your contribution depends entirely on the specific entity you choose to support:
- The 501(c)(3) Entity (Scholarships): Contributions made to the designated 501(c)(3) entity are made to a registered tax-exempt charity. These donations may be tax-deductible to the extent permitted by law.
- The 501(c)(7) Entity (Brothers’ Philanthropy): Contributions supporting the social and recreational operations of the fraternity are not tax-deductible as charitable contributions for federal income tax purposes.
- The C-Corporation (369 College Avenue Inc. / House Fund): Contributions or payments made to the C-Corporation support the management and maintenance of the physical property. These payments are strictly gifts or capital contributions and are not tax-deductible as charitable contributions.
Specific tax disclosures and member affirmations are provided and agreed to at the point of transaction on the donation page.
3. Nature of Contributions, Perks, and Sales
- Voluntary Support: All donations made through the Website are given voluntarily to support the respective entity’s operations and mission. Unless specifically restricted at the time of giving, funds are unrestricted and utilized at the discretion of the receiving entity’s governing board.
- Promotional Periods and Quid Pro Quo: From time to time, Delta Psi Delta Fraternity Corporation may offer promotional items or perks during specific fundraising campaigns. The specific terms, limitations, Fair Market Value (FMV), and opt-out options for these items are disclosed at the point of transaction and are incorporated by reference into these Terms. For 501(c)(3) donations involving a perk, your tax-deductible contribution is limited to the amount paid in excess of the item’s FMV.
- Product Sales: Payments made specifically for physical merchandise to the 501(c)(7) or the C-Corp are considered purchases and are not tax-deductible. Any stated shipping or handling fees are non-refundable.
4. Payment Processing
We facilitate secure transactions through separate, dedicated accounts for each entity to ensure funds are not commingled.
- Accepted Methods: We accept contributions via Stripe, PayPal, Zelle, ACH bank transfers, physical checks, and physical cash.
- Third-Party Processors: Digital transactions are handled by secure, third-party payment processors. By utilizing these methods, you agree to their respective terms of service and privacy policies. Delta Psi Delta Fraternity Corporation does not store your full financial or credit card information on our servers.
- Offline Payments (Checks & Cash): * Checks: Must be made payable explicitly to the precise legal entity intended for support and mailed to the address provided on the donation page.
- Cash: Cash contributions are only accepted in person via an authorized officer of the Delta Psi Delta Fraternity Corporation or its respective entities. To ensure accurate routing and tax reporting, cash donors must request and retain a standardized receipt at the time of the transaction that explicitly designates the receiving entity. We are not responsible for cash sent through the mail or handed to unauthorized individuals.
5. Refund and Exchange Policy
- Donations: Due to the nature of voluntary giving and the immediate deployment of funds for operational use, all donations are final and non-refundable. If a donation was made in error (e.g., an accidental duplicate transaction or an incorrect amount entered), please contact us within 14 days of the transaction. We will work with you in good faith to review and correct genuine entry errors.
- Products/Perks: If a physical product or promotional perk is received and is found to be damaged or defective upon arrival, please contact us within 14 days for a replacement. We do not offer traditional refunds or size exchanges for promotional campaign items once a fundraising drive has concluded.
- Fulfillment: Perks and products are provided on an “as available” basis. If a specific item becomes unavailable after a payment is made, we reserve the right to provide a substitute of equal value or treat the full amount as a pure donation to the intended entity.
6. Acceptable Use of the Website
You agree to use the Website only for lawful purposes. You are prohibited from:
- Attempting to bypass security measures, access restricted administrative areas, or manipulate the payment routing systems.
- Using the Website to distribute malicious software or spam.
- Falsely representing your identity or affiliation when interacting with the Website or making a transaction.
7. Intellectual Property
All content on this Website, including text, graphics, logos, images, and custom code, is the property of Delta Psi Delta Fraternity Corporation or its respective entities and is protected by intellectual property laws. Reproduction or unauthorized use of this content is prohibited.
